Lovely Joan Gallo brought this poorly constructed constitution violating law to us. However, her description leads one to believe it was NEVER intended to be used as it is being used. It appears clear from context that the cities were given a little bitty law, with the legislature never intending that the cities would make everything in their boundaries illegal so that they could fine you. San Jose's fine was just $25. Now we have $500,000 citations. OBVIOUSLY these massive fines were not meant for a "subordinate judicial officer" or limited civil jurisdiction. The law was never intended or planned to be used how it is being used. The cities have usurped the intent of the law. This is what creates utter confusion in reading its text and applying it to the facts.
